Subscription Billing Dates and Terms

Customers purchase a Subscription to use Drive My Way’s services.

  • Subscriptions are based around the customer’s Billing Date which is the day of the month the subscription is first activated. Subscriptions with a billing date of the 31st will adjust to the last day of the month for months with less than 31 days.
  • Subscription Term represents the period of time for which the subscription will be active. Drive My Way provides customers the ability to purchase a 6-month or 12-month subscription. The term start date is based on the customer’s billing date, which is the day of the month the customer’s subscription is first activated. A subscription term starts on the customer’s billing date, with the end date being 6 or 12 months after the start date depending on the term length chosen.

Payment Terms & Conditions

The following payment terms and conditions apply to Premium and Enterprise Subscription customers.

  • Premium & Enterprise subscriptions may be paid by credit card, ACH or check.
  • Customers will be billed at the start of the term and thereafter, monthly on the Billing Date for customers paying monthly. Customers paying in-full will be billed at the start of each term.
  • Customers paying by credit card will be billed at the start of each term and applicable Billing Date (monthly or at the start of the next term).
  • Customers paying by ACH or Check will be invoiced at the start of each term and applicable Billing Date and provided Net-30 terms. Full payment must be received no later than 30 days after the invoice date.
  • Outstanding balances over 30 days will be subject to late fees at a rate of 1.5% per month. Late fees are calculated monthly on the Billing Date of the customer.
  • Drive My Way has the right to pause services for customers with balances greater than 60 days. Drive My Way will communicate to the customer when their subscription will be paused due to non-payment. Customers will be responsible for all fees incurred up until Drive My Way pauses services and any additional late fees incurred on outstanding balances after the subscription has been paused. Customer ‘s remaining full term will be deferred, and the customer will be responsible for the full remaining term after invoices are paid and subscription is re-activated.

The following payment terms and conditions apply to Small Fleet Subscription customers.

  • Small Fleet Plan subscriptions must be paid, by credit card, with fees due at the start of the trial and thereafter, on each billing date.
  • Outstanding balances over 30 days will be subject to late fees at a rate of 1.5% per month. Late fees are calculated monthly on the Billing Date of the customer.
  • Payment for plans and add-ons added after the start of the subscription will be due when they are activated. Customers will be billed via credit card. If a job or add-on is added between Billing Dates customers will be billed for a prorated amount.
  • Drive My Way has the right to pause services for customers with balances greater that 60 days. Drive My Way will communicate to the customer when their subscription will be paused due to non-payment. Customers will be responsible for all fees incurred up until Drive My Way pauses services and any additional late fees incurred on outstanding balances after the subscription has been paused.

The following payment terms and conditions apply to all customers.

  • Subscription plans are quoted exclusive of sales tax. Any applicable sales tax will be applied to invoices based on the billing address of the customer.

Subscription Plan Changes

Drive My Way understands a customer’s hiring needs may change over the course of their subscription.

  • The Base Subscription represents the plan, job slots and add-ons in place at the start of each subscription term.
  • Customers can adjust their Base Subscription prior to the start of each term. After each term begins customers can add and remove job slots and add-ons but cannot remove or change the initial job slots and add-ons included in the Base Subscription until their new renewal.
  • Job slots and add-ons are required to be active for a minimum of 30 days. Some add-ons may require a longer activation period. Your Drive My Way support specialist will let you know when you are purchasing an add-on with a longer required activation window.
  • Job slots and add-ons added between Billing Dates will be prorated for the days between when the job or add-on is activated and the next Billing Date.
  • Customers on “in full” subscriptions (paying for the full subscription at the start of each term) that purchase add-ons and jobs will be billed for the full remaining term for the add-ons and jobs. If the customer later decides to remove the job or add-on a credit for the remainder of the term will be issued to their account and used to offset their next invoice.

Subscription Renewals and Cancellation

Drive My Way subscriptions renewal process works as follows.

  • Subscriptions auto-renew at the end of each subscription term unless the customer provides written notification that they do not intend to continue with the subscription.
  • Pricing is valid for each term. Subsequent renewals will be at current market rates at time of renewal.
  • Customers must provide written notice at least 30 days prior to the end of each subscription term. This notice, via email, can be provided to the Drive My Way account lead, sales executive or emailed to billing@drivemyway.com.
  • Small Fleet Plan customers on an initial Trial plan must provide written notice no later than 15 days prior to the end of the trial or the subscription will auto-renew as a 6-month, paid monthly subscription at the end of the trial. After the initial trial, Small Fleet Customers must provide written notice of non-renewal at least 30 days prior to the end of each 6-month term.
  • Subscriptions renew on 12-month terms for Premium and Enterprise customers unless agreed to otherwise by both parties in writing. Small Fleet customer plans auto-renew on 6-month terms.
  • Customers with a 3-month initial term opt-out must provide notification at least 30 days prior to the end of the initial 3-month period or the plan will continue for the length of the initial term. Opt-out terms only apply to the initial term.
  • Customers eligible for and electing to use Cruising will have their full subscription term extended by the length of the time cruising, a minimum one month.

Job Slots and Job Changes

  • Job Slot represents a unique position that the customer is looking to fill. Customers purchase a specific number of job slots as part of their Drive My Way subscription.
  • A job slot represents one unique position, defined at a distinct location, pay & benefits structure, job duties and qualifications. Multiple positions with uniqueness in any of these areas, cannot be combined into a single job slot.
  • Customers are not restricted on the number of hires they can make for one job slot. Drive My Way understands job requirements may change from time to time. Customers can request to update a job slot with minor changes at any time. Updates for minor change requests will be completed within the response time outlined in the plan purchased.
  • Material changes to the job slot (different hiring area, different qualifications or meaningfully different job responsibilities) constitute a job “swap.” Jobs may be swapped based on the terms of the specific plan purchased, as frequently as semi-monthly (2 times a month) for Enterprise customers and monthly for Small Fleet and Premium Plan customers (unless the Premium customer has purchased Premium Plus account support).

Job Activity Dashboards

Drive My Way provides details on each interested driver via the customer’s Job Activity Dashboard.

  • Small Fleet Plans include a read-only, online dashboard that include each interested driver, organized by job.
  • Small Fleet Plan customers can upgrade to a Disposition Dashboard.
  • Premium and Enterprise Customers will use a Disposition or Reporting Activity Dashboard.
  • A Disposition Dashboard is an interactive interface that the customer uses to manage the status of each interested driver. Disposition Dashboards are used by customers with no ATS or those using an ATS that is not currently integrated with Drive My Way.
  • Small Fleet Customers who have purchased a Disposition Dashboard, and Premium customers use standard Disposition Dashboard with a standard set of views & disposition status codes. Premium Plus Account Support and Enterprise customers can customize the views and disposition status values in the disposition dashboard.
  • Customers with a Drive My Way ATS integration use Reporting Activity Dashboards. These dashboards use the customer’s specific disposition status values and are updated by a disposition status report provided by the customer, extracted from the ATS.
  • Each subscription plan comes with a designated number of users for these activity dashboards. Customers may purchase additional users as part of their subscription.

Cruising: Eligibility and Conditions

Cruising provides customers the ability to pause the full Drive My Way subscription for a period of time keeping jobs active with an alert to job seekers that hiring has been paused and giving job seekers the option to sign up to be notified when hiring resumes.

  • Small Fleet Plan customers are not eligible to Cruise during the initial 3-month trial period.
  • Small Fleet Plan customers can purchase a Cruising add-on at the start of each term that provides the option to Cruise their plan during that term.
  • Cruising is included for Premium Plans with no additional add-on purchase necessary. Cruising is not offered with Enterprise Plans.
  • There is a monthly fee for Cruising (25% of the monthly Subscription fee).
  • Customers on plans eligible for Cruising may cruise up to 2 months per 6-month term. After two months the customer will be moved back to the full subscription. Customers must provide, in writing, the request to Cruise and return from Cruising. Cruising for less than one month or a partial month will use at least one month of Cruising eligibility.
  • When in Cruising, the customer’s full subscription term obligation is deferred. Customers are required to complete the remaining months of the full subscription after coming off Cruising. Example: Customer Cruises with 2 months left of full term for one month. After coming off Cruising, the customer has 2 months remaining on the full subscription.
  • Customers can move on and off Cruising on their designated Billing Date (the day of the month they started their subscription). If a customer chooses to move to or returning from Cruising prior to their billing date, the pro-rated amount of the full term will be added to the remaining full subscription term. Requests to move to or out of Cruising outside of the billing date may take up to 3 business days.

Marketing Boosts

Customers can add Marketing Boosts, in paid increments, to increase the volume of interested drivers.

    • Marketing Boosts can be purchased in blocks starting on the customer’s Billing Date.

Marketing Boosts purchased between Billing Dates will be charged a pro-rated basis.

  • Customers can communicate on a monthly basis, in advance of their Billing Date, which job(s) should be targeted with the Marketing Boosts. Drive My Way will use best efforts to allocate to customer requests.
  • Marketing Boosts will increase the amount spent on job marketing efforts but Drive My Way cannot guarantee the level of increased interested driver volume based on additional Marketing Boosts purchased.

Screening Services

Premium and Enterprise Plan customers can purchase an add-on to have Drive My Way screen interested drivers with additional questions before sending them to the customer.

  • Screening questions must be specific to bona fide job qualifications or willingness / ability to perform a bona fide job requirement with or without accommodation.
  • Up to 5 Screening questions can be asked to a driver.
  • The Screening questions must be the same for all jobs.
  • Screening applies to all active jobs unless the customer communicates which jobs to exclude from screening at the start of each Billing Date.
  • Screening includes up to 40 interested drivers screened per job month (additional blocks can be purchased).
  • The Screening-add on must be active for at least one job for a minimum of 90 days. Screening fees are per job per month.

Re-engagement Campaigns

Premium and Enterprise Plan customers can elect for Drive My Way to attempt to re-engage interested drivers that have been or become unresponsive to the customer.

  • When purchased, Drive My Way will attempt to re-engage a driver who has been documented by the customer with an “unresponsive” or equivalent disposition status. Drive My Way when contacting the driver will attempt to determine if they are still interested, and if so when they are best available to speak with the customer, or if they are no longer interested, why.
  • Drive My Way will use a combination of SMS, email and outbound calling to engage unresponsive drivers. Re-engagement will include a minimum of up to one text/email and two Match Maker call attempts.
  • Drivers who are unresponsive will be marked as DMW unresponsive.
  • Drive My Way will communicate to the primary customer contact (or a designated contact or email address) when drivers have been re-engaged and are still interested in the position.
  • Re-engagement Campaign fees are per job per month.
